DISPATCH PRIVACY POLICY

Dispatch Technologies, Inc. (“Dispatch” “us,” “our,” or “we”) values your privacy. Dispatch provides on-demand services and real-time work force tracking solutions (the “Dispatch Services”) through our mobile applications (our “Apps”), our website at www.dispatch.me (“Site”), and for some businesses using our Dispatch Application Programming Interface (“Dispatch API”) to integrate with our systems.

This privacy policy (“Privacy Policy”) describes the type of information our Site, our Apps and the Dispatch Services collect from you, our practices with respect to the information we collect, and the steps we have taken to protect that information. By visiting our Site, or by using our Apps or the Dispatch Services, you are expressly consenting to the collection, use and disclosure of your Personal Information and User Information (as defined below) in accordance with this Privacy Policy, and you are agreeing to be bound by our Terms of Service. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY OR THE TERMS OF SERVICE, PLEASE DO NOT VISIT OUR SITE OR USE THE APPS OR THE DISPATCH SERVICES.

WHAT INFORMATION DOES DISPATCH COLLECT?

Dispatch collects certain information from (i) third party enterprise partners (“Third Party Partners”) using the Dispatch Services to facilitate and track job appointments, (ii) Service providers (“Service Providers”) using the Dispatch Services to manage information about and fulfill job appointments, (iii) Clients and customers (“Customers”) of Third Party Partners and Service Providers using a customer portal powered by Dispatch or hosted by a Third Party Partner or Service Provider (for example, to book a service appointment) (a “Customer Portal”), and (iv) visitors to our Site (collectively, “Users,” “you” or “your”). We use information collected from Users in accordance with this Privacy Policy to provide and enhance the quality of the Dispatch Services and for our internal business purposes.

Types Of Data We Collect.

Personal Information. Dispatch may collect certain personally identifiable information from Users, such as name, address, email address, business name, telephone number, zip code, images, photographs, and other contact or non-public information about an individual that is associated with or linked to any of the foregoing data. We call this information “Personal Information.” We don’t share Personal Information with third parties except as specified in this Privacy Policy.
Third Party Information. From Third Party Partners we may additionally collect information about their current or future potential customers or clients, including information about past or future services jobs performed for these customers or clients.
App Information. Dispatch collects information from Third Party Partners and Service Providers about their use of our Apps. Such information may include language preference, phone number, the make and model of any phone or device used to access the Apps, the mobile operating system, the type of browser in use with the Apps, IP address or other unique mobile identifiers, and geolocation data. We call this information “App Information.”
Analytics Information. Dispatch has partnered with Google Analytics, FullStory and Pendo.io (collectively, “Analytics Partners”) to collect information about how our Site, Apps and the Dispatch Services are used. This data may be associated with or linked to Personal Information. You can learn more about these data collection practices by referring to the “HOW ARE COOKIES AND TRACKING TECHNOLOGIES USED” section below.
Anonymous Information. We may automatically collect non-personal information about your use of the Dispatch Services, or our Site or Apps, through cookies, web beacons and other technologies as more fully described in the “HOW ARE COOKIES AND TRACKING TECHNOLOGIES USED” section below. Such information may include domain name, browser and operating system type, web pages viewed, links clicked, IP address, duration of visit to our Site or use of our Apps, among other things. We call this information “Anonymous Information.” For clarity, Anonymous Information is data which are not associated with or linked to your Personal Information and which do not alone permit the identification of individual persons.
Information Collected Through Certain Functionalities.

Dispatch Accounts. We collect certain Personal Information from Third Party Partners and Service Providers when they set up a Dispatch Account through a Dispatch API or through our Apps, such as the name of the individual registering for the Dispatch Account, that person’s business and personal phone number and e-mail address, the employer’s name and physical address, the individual’s image, and any other information voluntarily provided by the Third Party Partners or Service Providers or generated through their use of the Dispatch Services. In connection with establishing a Dispatch Account to use the Dispatch Services, we require Third Party Partners and Service Providers to use their phone number or e-mail address to create a username, and also to set up a custom password, which may be changed according to the methods provided by the Dispatch Services. The security of a Dispatch Account relies on protection of account credentials, and Third-Party Partners and Service Providers are responsible for maintaining the security of their account credentials and are solely responsible for any and all activities that occur under their Dispatch Account. Dispatch will never request a password or other sensitive information be sent to us in an e-mail, though we may request that this information be entered through the Dispatch API. If someone has obtained access to your password, please change it immediately. If you believe that an unauthorized access has already occurred or may occur please report it immediately to legal@dispatch.me. It is crucial that you promptly notify us if you become aware that any information submitted through the Dispatch Services is lost, stolen or used without permission.

Requesting a Demo. If you request a product demonstration through our Site, we ask you to provide your first and last name, company name, e-mail address, phone number and information about how you heard about us. We will use this information to contact you about scheduling a demonstration of the Dispatch Services and to stay in touch with you about our other products and services.

Mailing List. We ask you to provide your email address when you request to join our mailing list. By doing so you may receive Promotional Emails as defined below. You may opt out of such emails by following the unsubscribe instructions provided in the e-mail you receive. You may not opt out of emails related to the operation of the Dispatch Services as these may be necessary for their normal functionality.

Submitting a Blog Topic. On our Site we provide a web form for submitting ideas for blog topics and we ask you to provide your name, email address and topic idea. We also provide the e-mail address of a company contact if you would prefer to submit your ideas directly to our blog editor. We may use the information you provide to communicate with you about your blog topic idea and to stay in touch with you about our products and services.

Feedback/Support. If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply.

Your Choices Regarding Your Personal Data.

Promotional Emails. We may periodically send you newsletters, surveys, offers and other promotional materials related to Dispatch, the Dispatch Services, or services offered by our Third Party Partners and Service Providers (“Promotional Emails”). Additionally, we may send you targeted offers from third parties (“Third Party Emails”), or deliver authorized Third Party Emails on behalf of certain third parties. When you receive Promotional Emails or Third Party Emails from us, you may indicate a preference to stop receiving these communications and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive. If you have opted out of Promotional Emails or Third Party Emails, we may still contact you in connection with your relationship, activities and/or transactions with Dispatch, including notices of any updates to our Terms of Service or Privacy Policy.

Geolocation and Push Notifications. You may at any time opt out from further allowing Dispatch to access geolocation data or send you push notifications by adjusting your permissions or disabling these functions on your mobile device; however, please note that our Apps and the Dispatch Services may not function properly if you disable these functions.

Text Messages. Dispatch may send notifications, alerts or other communications via text message to Customers and Service Providers in order to provide the Dispatch Services. Please be aware that standard text (SMS) message and data rates may apply. If you no longer wish to receive text messages from Dispatch, please reply “STOP” to discontinue this functionality.

Uninstalling an App. You can stop all collection of information by one of our Apps by uninstalling the App. You may use the standard uninstall processes as may be available as part of your mobile device.

Changes to Your Personal Information.

Users may update or delete certain of their Personal Information in their Dispatch Account by editing their account profile. Users may also request deletion of their Personal Information by us, but please note that we may be legally required to keep certain information and not delete it (or to keep this information for a certain length of time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When you or we delete Personal Information, it will be deleted from the active database, but it may remain viewable in cached and archived pages of the Site or applicable App for a period of time.

Otherwise Dispatch will retain Personal Information on servers for the Dispatch Services for as long as needed to provide the Dispatch Services and to comply with our legal obligations, resolve disputes and enforce our agreements. We will retain all other types of information in accordance with internal record retention requirements and business requirements.

WHAT DOES DISPATCH DO WITH THE INFORMATION IT COLLECTS?

Dispatch’s Use of Personal Information.

Dispatch collects and uses Personal Information to (i) operate the Site and Apps and to provide the Dispatch Services, (ii) to respond to requests and inquiries, (iii) to send Users updates and alerts, (iv) to notify Users about important changes to our Site, Apps and/or the Dispatch Services, (v) to review Site and App usage and operations and to improve the quality and functioning of our Apps and our Site, (vi) to protect the security or integrity of our Site, Apps, the Dispatch Services, or our business, (vii) to enforce our Terms of Service, and/or (viii) to tailor the Site, Apps and/or the Dispatch Services to Users’ needs.

Dispatch does not sell, lease or rent the Personal Information Users provide to us. However, Dispatch may disclose Personal Information from Users to third parties only (i) as required by law or regulation or as we believe in good faith that disclosure of such Personal Information is reasonably necessary to: (1) satisfy any applicable law or regulation, (2) to respond to claims and/or to comply with a judicial proceeding, court order or legal process served on us, (3) to protect and defend our rights or property and/or the rights or property of third parties, as permitted by law, (4) to detect, prevent or otherwise address fraud, security or technical issues; or (5) to enforce our Terms of Service; and/or (ii) with Third Party Partners and Service Providers as described below. We may also share Personal Information with our affiliates and subsidiaries who are bound by this Privacy Policy and our Terms of Service.

Dispatch’s Use of your App, Analytics, and Anonymous Information.

Dispatch uses App Information, Analytics Information and Anonymous Information (collectively, “User Information”) to provide and enhance the quality of the Dispatch Services, our Apps and our Site, to communicate with Users, to market additional products and services to Users, and for our internal business purposes. We may share User Information with our affiliates and subsidiaries who are bound by this Privacy Policy and our Terms of Service. Also, Dispatch may sell, rent or share User Information derived from its Apps, Site and/or the Dispatch Services which is not personally identifiable with third parties for any purpose in its discretion.

Sharing Personal Information and User Information with Third Party Partners and Service Providers.

Dispatch may share Personal Information and User Information with certain Third Party Partners and Service Providers to perform the Dispatch Services and to facilitate customer relationship management; please note, if you are a Service Provider, we may share Personal Information of your employees with Third Party Partners for whom you perform service appointments. We may also share Personal Information and User Information with other third party vendors, services providers, contractors or agents that provide certain services to us such as order processing, customer relationship management, database storage, hosting and management, advertising, and direct marketing campaigns. To be clear, if you are an individual scheduling a service appointment using a Customer Portal located on the website of one of our Third Party Partners or Service Providers, Dispatch may share your Personal Information with that Third Party Partner and any Service Provider engaged to provide the requested services.

Acquisition or Sale.

If Dispatch is acquired or sold to another company, either through merger or the transfer of substantially all of our assets, or if we seek bankruptcy protection, Dispatch may transfer the information we have collected to another company.

HOW ARE COOKIES AND TRACKING TECHNOLOGIES USED?

Dispatch’s Use of Cookies and Tracking Technologies.

Dispatch may at its discretion use both “session” and “persistent” cookies or beacons on its Site or in our Apps. To help you understand these technologies better:

“Cookies” are electronic files many websites or applications place on a visitor’s computer or device to store information that makes each visit more efficient. A session cookie stores information about you only while you are interacting with a website or application, and is then deleted when the interaction stops. Persistent cookies store information about you, your preferences, and information about other websites you visit, and it remains on your computer or device. To remove cookies, you may configure your browser to clear all cookies, or configure it to reject cookies. Please consult your browser’s user guide for specific instructions on removing cookies.

“Beacons” are small graphic files with a unique identifier that are used to track a web or mobile user’s online movements. Unlike cookies, beacons are embedded on websites or devices, not downloaded on your computer or device. Dispatch may use beacons to better manage content on our Site and to improve the use and efficiency of our Apps.

Analytics Partners’ Use of Cookies and Tracking Technologies.

Our Analytics Partners named above may use cookies, beacons or other automated technologies to collect information about how many times you visit the Site or use our Apps, which parts of the Site and/or Apps you access, and the functionality you are using, among other data elements.

In order to make sure you understand how our Analytics Partners handle your information and how they interact with the Site and Apps, we have shared hyperlinks below to their policies. We encourage you to review these terms as Dispatch has no ability to control or monitor our Analytics Partners’ data collection or data use practices.

Third Parties’ Use of Cookies and Tracking Technologies.

Our advertisers and partners may also use their own cookies or other tracking technologies that may collect information about you when you interact with the Site, Apps and/or the Dispatch Services. We do not control use of these tracking technologies used by advertisers and partners and expressly disclaim responsibility for information collected through them. When you use or connect to our Site, Apps or the Dispatch Services through a website owned and/or operated by a third party (a “Third Party Platform”), you hereby grant us access to collect certain information from your Third Party Platform profile/account. By doing so, you may also allow us to access information contained in cookies placed on your computer or device by the Third Party Platform as permitted by the terms of your agreement and privacy settings with the Third Party Platform. We may share this information with the Third Party Platform for their use as permitted by the terms of your agreement and privacy settings with the Third Party Platform. We may share some of the information we collect from you with vendors and other service providers who work with us to support the internal operations of the Site, Apps and/or the Dispatch Services.

BY AGREEING TO THIS PRIVACY POLICY AND USING OUR SITE, APPS AND/OR THE DISPATCH SERVICES, USERS CONSENT TO THE USE OF COOKIES, BEACONS AND OTHER TRACKING TECHNOLOGIES BY DISPATCH AND THIRD PARTIES AS SET FORTH IN THIS PRIVACY POLICY.

DO I NEED TO CREATE A DISPATCH ACCOUNT?

Third Party Partners and Service Providers using the Dispatch Services are required to create a unique profile called a “Dispatch Account” and share important information with us.

Customers of our Third Party Partners and Service Providers using Customer Portals powered by Dispatch or located on the websites of our Third Party Partners and/or Service Providers are not required to create a Dispatch Account.

DOES DISPATCH COLLECT PAYMENT CARD INFORMATION?

Dispatch uses third party payment card processors (“Payment Processors”) to process payment card transactions for purchases made through our Site or Apps. To make this possible, your name, payment card information, billing information, address, telephone number, email address and amount of your purchase are transmitted via secure (encrypted) gateway to the Payment Processors for the sole purpose of completing any transactions you initiate through our Site or Apps. Please note that your payment card information (number, expiration date, security code) is provided directly to the Payment Processors and is stored by the Payment Processors and not by Dispatch, and as such, it is important to review the Payment Processors’ policies to understand their information security practices. Our current Payment Processors are Stripe and Spreedly and links to their privacy policies are provided below. These privacy policies will apply to the information you provide to the Payment Processors. You hereby acknowledge and agree that Dispatch is not affiliated in any way with the Payment Processors and has no responsibility or liability for the services provided by the Payment Processors or for the Payment Processors’ acts or omissions. By purchasing products and services from Dispatch or through Dispatch’s Site or Apps, you agree to pay us, through the Payment Processors, all charges at the prices then in effect for the purchased products and services in accordance with the applicable payment terms and you authorize us, through the Payment Processors, to charge your chosen payment provider.

Dispatch does not collect payment card information directly and kindly asks you not to share this information with us when submitting requests for additional information.

DOES DISPATCH TRACK MY ACTIVITY ACROSS OTHER WEBSITES?

Dispatch may track your activity across multiple websites. When you visit our Site, we automatically collect the name of the website you visited from (called the “referring page”) and the name of the website you chose to visit immediately after ours (called the “exit page”), and information about other websites you have recently visited. This information is used for our internal business purposes, but we cannot identify you from any information we receive in this way. Please be aware that Dispatch’s systems do not respond to “Do Not Track” settings available on most browsers. When our Site detects the Do Not Track signal from your browser, it will still collect referring and exit page information and other information when you visit our Site.

CAN CHILDREN USE DISPATCH?

The Dispatch Services are not directed at children under 18, and we do not knowingly collect personal or other information from children under 18. Simply put, Dispatch does not permit children users under the age of 18 to use our Apps, Site or the Dispatch Services. If you are the parent of a child under the age of 18, and you believe he or she has shared information with Dispatch, please contact us at legal@dispatch.me so we can remove their information from our active systems.

WHAT IF I LIVE OUTSIDE THE UNITED STATES?

All of our Users should be aware that the United States and other countries have not harmonized their privacy regulations. Because Dispatch and its servers are located in the United States and the Dispatch Services are primarily directed towards the United States market, our Privacy Policy has been prepared to comply with applicable United States privacy laws and regulations. By accessing and/or using the Site, Apps or the Dispatch Services and providing Personal Information to us through the Site, Apps and/or the Dispatch Services, you agree to the level of privacy protection set out in this Privacy Policy.

WHAT IF I LIVE IN CANADA?

Canadian citizens, except under circumstances defined by law, are entitled to access their own personal information collected by Dispatch by writing to: Dispatch, Attn: Legal Department, 27 School St. 4th Floor, Boston, MA 02108. If you believe that the personal information about you that we have collected is incomplete or inaccurate, please contact us and we will correct the information upon verification of the omission or error and of the identity of the person requesting the change.

WHAT IF I LIVE IN CALIFORNIA?

California Civil Code Section 1798.83 permits Site visitors who are California residents and who have provided us with “personal information” (as that term is defined in Section 1798.83) to request certain information about the disclosure of that information to third parties for their direct marketing purposes. WHAT IF I FOLLOW A LINK TO A THIRD-PARTY WEBSITE?

Dispatch’s Site and our Apps may contain links to third party websites. Those websites are governed by their own privacy and data use practices and policies. Dispatch does not have control over the privacy practices of the advertisers or other third parties operating these websites, and we have no control over how these third parties collect or use the information you choose to share with them.

HOW DOES DISPATCH PROTECT MY INFORMATION?

Dispatch takes the security of your personal information very seriously. Dispatch uses reasonable administrative, physical and technical safeguards designed to secure the information you share with us. Despite these safeguards and our additional efforts to secure your information, no method of transmission over the Internet, or method of electronic storage, is fully secure. Dispatch cannot promise or guarantee that hackers, cybercriminals or other unauthorized third-parties will not be able to defeat our security, and improperly collect, access, steal or modify the information that you have shared with us.

WILL DISPATCH CHANGE THIS PRIVACY POLICY?

Dispatch may update this Privacy Policy from time to time to reflect changes to our Apps, Site or the Dispatch Services and/or to our information practices. If we make any material changes, we may notify you by posting a notice on our Site with a link to our revised policy or by sending an email message associated with your Dispatch Account. In every instance, we will change the “Last Updated” date at the top of the policy and we will describe these changes in a chart at the bottom of this Privacy Policy. We encourage Users to periodically review this Privacy Policy to understand our current information practices. Users can always refuse to accept changes to our Privacy Policy by ending their use of the Site, Apps and the Dispatch Services. Unless stated otherwise, our current Privacy Policy applies to all information that we have about Users. Continued use of the Site, Apps and/or the Dispatch Services shall be considered acceptance of any changes in the Privacy Policy.
